/end user licence agreement
This is a legal agreement between you ‘The Licensee’ and Kapitza.
We hereby grant to you a perpetual, non-exclusive, non-transferable worldwide license to use the Images for the Permitted Uses (as defined below).
By downloading an illustration, pattern, or font from the Kapitza website you are acknowledging that you have read the Licence Agreement below and are bound by the terms of this Agreement.
In this Agreement: ‘Kapitza Images’ means any illustration, pattern, or character from a Kapitza picture font that you are downloading from this site.
permitted uses
Kapitza Images MAY BE USED for:
Kapitza images may be used for most smaller projects under 10,000 quantity (print run, circulation, or impressions) and website graphics at a resolution no greater than 640×480 pixels, 72 dpi.
An extended license must be purchased for all larger applications and all categories listed below regardless of quantity.

Kapitza Images MAY NOT BE USED for:
Products for sale
Commercial products and promotional items given away free of charge
Packaging Design
Design template applications intended for resale, whether on-line or not, including, without limitation, website templates, Flash templates, business card templates, electronic greeting card templates, and brochure design templates
Websites or other venues designed to induce or involving the sale, license or other distribution of ‘on demand’ products, including postcards, mugs, t-shirts, posters and other items (this includes custom designed websites, as well as sites such as www.cafepress.com)
Logo and Trademark design
Branding
Pornographic, fraudulent, obscene, immoral, infringing, illegal, blasphemous or defamatory material
Creating derivative works by reverse engineering, decompiling or disassembling any part of the source code
Selling, sublicensing, distributing or otherwise granting rights or make available for use by others all or a portion of the Images
Sharing with others by installing the Images in more than one location at a time or posting a copy on a network server or web server
Reproducing the Images, or an element of the Images, in excess of 10000 times without obtaining an Extended License
third party licence
If you are an advertising agency, acting on behalf of an advertising agency or otherwise acting in a similar capacity or for the benefit of a third party, the purchase of a license for your client is required and depending upon the scope of the intended use, a license upgrade and/or the purchase of a special license may be required.
copyright
All Images are owned by Kapitza and are protected by Copyright law. No title to or intellectual property rights to the Images are transferred to you. Kapitza retains all rights not expressly granted by this License Agreement. All Rights Reserved.
credits
You agree to identify the Kapitza Images by name and credit Kapitza’s ownership of the trademarks and copyrights in any design or production credits.
font usage
By purchasing fonts from Kapitza, the user is transferred the right to use a limited number of copies of the original font software. This Licence is non-exclusive and not transferable to third parties. This License allows the use on up to five (5) devices (such as computer, printer, digital typesetting machine or other machines generating characters for processing) that belong to the same person or company. The Licence does not include the right of resale, sub-Licence and electronic transmission. The Licence does not include the right to modify, reformat or otherwise change the source-code of the font. You have no rights to the font software other than as expressly set forth in this Agreement. You agree that Kapitza owns all right, title and interest in and to the font software, its structure, organization, code, and related files, including all property rights therein such as copyright, design and trademarks rights. You agree that the font software, its structure, organization, code, and related files are valuable property of Kapitza and that any intentional Use of the font software not expressly permitted by this Agreement constitutes a theft of valuable property. All rights not expressly granted in this Agreement are expressly reserved to Kapitza.
embedding fonts
You may embed Kapitza fonts in documents as a rasterized representation of the font software (e.g. a GIF or JPEG) as long as the document is distributed in a secure format that permits only the viewing and printing but not the editing of the document and the document itself is not a Commercial Product. You need an Embedding Licence from Kapitza for embedding the font software in a Commercial Product.
limitation on liability
Kapitza does not assume any liability for damage – regardless of the type or extent of damage – resulting from the use of Kapitza Images by Licencee or a third party.
termination
Violations against this Licence by the Licencee shall automatically cause this Licence to be terminated. In such cases the relevant Images and all products containing the Images shall not be used, published, and/or distributed. All available copies of the Images shall promptly be destroyed. Kapitza reserves the right to initiate civil and criminal proceedings for violations against the Licence.
licence updates
Kapitza reserves the right, at its sole discretion, to change, modify, add, or remove any portion of this agreement, in whole or in part, at any time. By downloading an illustration, pattern, or font from the Kapitza website you agree to be bound by any such revisions and will therefore periodically visit this site or contact Kapitza to determine the then-current terms of this license.
